Terms & Conditions

A legal disclaimer

These Terms & Conditions (“Terms”) govern your access to and use of the services provided by London Damp Survey(“we / us / our”) and your use of our website (“Site”). By booking a survey or using our site, you accept and agree to be bound by these Terms.

1. Services

1.1 We provide independent damp, moisture, and indoor air quality (IAQ) surveying services (the “Services”) at customer premises in the London area, subject to these Terms.


1.2 We do not perform remedial or proofing work ourselves. If remedial work is required, we may refer you to a vetted third-party contractor; any such referral is subject to your choice.


1.3 We will carry out the survey using reasonable skill and care, in accordance with industry practices and applicable standards.

 

2. Booking, Payment & Scheduling

2.1 Booking is completed via our online booking system or by contacting us directly. You must provide accurate address and contact information.


2.2 Payment terms:

  • You may be required to pay a deposit or full payment in advance (as shown on booking).

  • The balance (if applicable) must be paid per our invoice terms (e.g. within 7 or 14 days).

  • All prices exclude VAT unless stated otherwise.
     

2.3 We will schedule the survey at a mutually agreed time. You must grant us reasonable access to the property at the booked time. If access is not granted at the appointed time this counts as a cancellation and we will keep the booking fee as  a cancellation fee.

2.4 If you have not specified the property's size correctly while making the booking based on square meters of the property, we have a right to refuse service if the correct amount isn't paid upon the appointment and keep the paid sum as a cancellation fee.


2.5 If you need to change or cancel, please provide notice at least 48 hours before the appointment; cancellation or rescheduling after that may incur a cancellation fee.

 

3. Client Obligations & Access

3.1 You must ensure that we can safely access the property and that the areas to be tested are made available (e.g. clear access to walls, vents, ducting).
3.2 You must disclose known conditions (e.g. recent flooding, hazardous materials) that could affect the survey or health and safety.
3.3 If we cannot access necessary areas or safely carry out testing, we may withdraw or limit our report; we may charge for aborted visits.

 

4. Deliverables & Reports

4.1 After the survey, within our stated turnaround time (e.g. 3–5 working days), we will deliver a report that includes our findings, photos, moisture/IAQ readings, and recommendations.
4.2 Our report is for your personal use and may be shared with relevant parties (landlord, housing officer, solicitor) as needed.
4.3 We retain the right to redact or anonymise identifying information if sharing for casework or reference.
4.4 Our recommendations are opinions based on available data and methods. You may act on them at your discretion.

5. Limitation of Liability

5.1 Subject to clause 5.3, our liability for direct loss or damage arising from negligence, breach of contract or otherwise in connection with these Terms shall not exceed the total amount you have paid us for the specific survey in question.
5.2 We are not liable for indirect, consequential, or special losses (e.g. business interruption, loss of opportunity, legal fees, etc.).
5.3 Nothing in these Terms limits our liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.
5.4 You agree to indemnify us against claims, damages, or losses arising from third-party actions if attributable to your breach of these Terms.

6. Intellectual Property

6.1 The content on our Site (text, graphics, logos, images) is our intellectual property or licensed to us. You may view, download or print pages for your personal, non-commercial use only, subject to these Terms.
6.2 You must not reproduce, distribute, or build upon our content without our express written permission.

7. Privacy & Data Protection

7.1 We process your personal data in accordance with our Privacy Policy (link).
7.2 You consent to us using your data to provide services, communicate with you, fulfill contractual obligations, and for marketing (where you have consented).
7.3 We may share your data with third parties (payment processors, labs, proofing partner if you agree) under confidentiality agreements.

8. Complaints & Dispute Resolution

8.1 If you have a complaint, please contact us at [your contact email/phone]. We will try to resolve matters amicably and promptly.
8.2 If we cannot resolve it, you may refer to mediation or arbitration (where agreed), or bring a claim in UK courts, in compliance with applicable law.

 

9. Modifications

9.1 We may revise these Terms from time to time. The updated version will apply from the date posted on our website under “Terms & Conditions.”
9.2 If you object to changes, you should refrain from using our services after the new version becomes effective.

 

10. Governing Law & Jurisdiction

These Terms are governed by the laws of England and Wales. Any dispute will be subject to the exclusive jurisdiction of the courts of England and Wales.
